Islamic Genius, AMK

Reader comment on item: Islamophobia?

***You didn't answer my question, will cutting off hands increase or decrease crime....***

Sorry, AMK, for having overlooked this classic case of Islamic genius in jurisprudence. This was the second time you asked, and my brain must have numbed over for a long time, but its thawing pretty fast now.

Supposing all secular nations decided to apply this law to Muslim criminals in their midst, and in the international courts. Will it permanently put paid to their headaches on account of Islamofascism or not?

Where shall we begin? There's Saddam Hussein for one thing. And all the terrorists pending trial, including Omar Shaikh in Pakistan. Surely Pakistan would not object to Sharia' law? In fact we need not wait for the niceties of western human rights conventions, but follow the magnificent example of Taliban. Will it put an end to terrorism or not?

Or say we start with A. Q. Khan, the pride of Pakistan, the father of the proliferating Pakistani nuke, for having *stolen* the Dutch nuclear designs. See:
http://www.isis-online.org/publications/southasia/khan_memo.html, http://www.saag.org/papers6/paper567.html

" Dr A.Q. Khan is the only Pakistani to have received the highest civilian award of "Nishan-I-Imtiaz"(NI) twice -in 1996 and 1998. He also has received the honour of Hilal-I-Imtiaz. (HI). Yet, his critics call him differently, such as "Evil Scientist", "Rogue Scientist", "Horrible Example" etc."

-- Will your suggested punishment of chopping off hands in this case effectively seal the nuclear blackmarket or not, AMK?

Then there are the likes of Dawood Ibrahim, the most wanted man on earth, currently enjoying Pakistani hospitality in Karachi. Will this put an end to the underworld weapons trade, hawala rackets and narco-terrorism or not?

Chopping the hands (and feet) of Muslim criminals currently languishing in police custody and prisons of India. Will this end at least 80% of crime in India or not? Applying the same law to beleagured countries like France, UK and the US -- will it see a felicitous end to major criminal activity or not?

And there is a real 'manna from the heaven' side effect to this: Will it summarily end criminal conversions to Islam, putting an end to the demographic threats or not?

And closely related to the above, supposing we were to naturally stretch the law a little bit, by castrating all Muslim rapists. --Will it put an end to most of the rapes or not?

Supposing the above rule was applied to all the fathers-in-law who rape their sons' wives (assuming that Allah has not granted them special pardon as in the case of his beloved Prophet). --Will it put an end to this crime or not?

Now Yuval Brandsetter, MD, commenting elsewhere in this site, offered the idea that most criminals converting to Islam were because it placed them in a considerably superior position over its women. A sage friend, responding to that theory, offered the following:

"But, criminals - even according to the laws prevailing in Muhammad's (PBUH) Arabia - were the first "natural" converts to Islam, because it gave them much-aspired-for legitimacy!!!!! A brigand faith is a brigand faith after all....."

--Elaborating on it, I'd say that most religions are meant to temper negative aspects of human nature among their adherents, for which purpose certain codes were dictated, so as to bring them within the fold of human 'civilisation'. There is plenty of scope offered for errant behaviour being corrected and reformed through relatively humane censure and punishment.

We are agreed that Islam charts the opposite course, variously. I see another spin off in applying the Islamic code to Muslim criminals: This is likely to swell the ranks of beggars with no other means of sustenance outside the mosques on Fridays, mopping up most of the Islamic charities that otherwise go into funding criminal and terrorist activities. It would effectively serve to neutralise the threat of Islamofascism in a dual manner.

--Do you agree or not, AMK?

Such logic applied selectively to Muslims might sound a trifle evil to you, AMK, but may I say it here that the idea came out of your warmly fecund brain, repeatedly, to enliven this debate in its current round?
