To Moderate Muslim: On rape and chopping off hands

Reader comment on item: How the West Could Lose
in response to reader comment: Condemnable Offenses. Controlling Men

Submitted by Plato (India), Mar 12, 2007 at 23:18

This is what you say Moderate Muslim:

"You adressed the rape of women and the witnesses. These laws are wrong, and they are not Islamic. For instance, if you have three men who witnessed a rape, and did not stop it, they should be executed. Women must be protected from these laws by people who are willing to condemn these governments.

What I am trying to say is that these laws are not Islamic, but that they were invented by modern day men who use them as control mechanisms, and this is wrong, and this should be stopped"

How do you counter this:

Narrated 'Aisha:

The Prophet said, "The hand of a thief should be cut off for stealing a quarter of a Dinar."

If they are wrong how come in strongly Islamic countries these laws are applied. Pakistan, Iran, Saudi Arabia and some other Arab countries. If they are wrong it means hundreds of Islamic scholars are wrong. Islamic scholars and ordinary Muslims rioted violently against the Danish cartoons but you hardly ever hear anyone protesting what is happening in these Muslim countries where innocent rape victims are made to suffer. As a true Muslim you cannot oppose the Sharia.

Can you tell me honestly after reading the hadiths I have quoted by Aisha and Abu Hurraira, that you will oppose a call to implement this law of chopping off a person's hands for stealing even a quarter of a dinar or an egg.

Volume 8, Book 81, Number 781:

Volume 8, Book 81, Number 780:

Volume 8, Book 81, Number 786:

Volume 8, Book 81, Number 787:

Volume 8, Book 81, Number 791:

Narrated Abu Huraira:

Allah 's Apostle said, "Allah curses the thief who steals an egg (or a helmet) for which his hand is to be cut off, or steals a rope, for which his hand is to be cut off."

In Saudi Arabia, Iran, Nigeria and other Islamic countries millions are siphoned off by individuals in government from the revenues generated from wealth belonging to the people and from taxes paid by the poorest of the poor. Have you heard of any call by the scholars of Islam to include these crimes in the sharia law against theft. I found two Koranic verses about embezzlement of property of orphans but there is nothing about any punishment for them. But physical theft of even a quarter of a dinar is punishable by cutting off of the offending hand. Embezzlement is merely called a great sin and punishment is promised in the hereafter. And this is the Book you say contains all wisdom.

004.002 To orphans restore their property (When they reach their age), nor substitute (your) worthless things for (their) good ones; and devour not their substance (by mixing it up) with your own. For this is indeed a great sin.

004.010 Those who unjustly eat up the property of orphans, eat up a Fire into their own bodies: They will soon be enduring a Blazing Fire!

Narrated Ibn 'Umar:

Allah's Apostle cut off the hand of a thief for stealing a shield that was worth three Dirhams.

Narrated 'Aisha:

A thief's hand was not cut off for stealing something worth less than the price of a shield, whether a Turs or Hajafa (two kinds of shields), each of which was worth a (respectable) price.

Narrated 'Aisha:

The Prophet said, "The hand should be cut off for stealing something that is worth a quarter of a Dinar or more."
