The Prophet of Islam taught Courtesy and Honor to even the enemies of Islam. I think they are withdrawing because they want to follow that example.
You should know that any time a "counterterror expert" is sued by any Muslim, the Muslim won, as the article of Dr Pipes gives two examples. So they are not withdrawing because they are losing as you said.

Furthermore, As citizens of this country, the Muslims have the full right to SUE any individual or organization who writes Bogus stuff against Muslims/Islam.

It seems to me that YOU people are never pleased with any Muslim.
If the Muslims take action against their enemies with their hands, you disapprove of that.
If the Muslims take action against their enemies with their voices, you disapprove of that.
If the Muslims take action against their enemies using the Courts, you disapprove of that.

Reminds me of a verse in the Holy Quran: "O Muslims the Yahood and the Disbelievers will never be pleased with you unless you become like them...."

So, let me say from the top of my voice: We the Muslims will NEVER EVER become like YOU !!
