So far as I know Malkin has not retreated. Look at John J. McCloy's testimony in a 1983 congressional hearing on the matter. He cites the MAGIC intercepts that justify the relocation (not internment) of American citizens who are nissei or issei, first or second generation American citizens of Japanese descent. It has long been a part of International Law that enemy aliens could be interned during wartime. However relocating American citizens is a further step and I agree, shouldn't have been done unless there was justification. But there was justification as found by John J McCloy, FDR and the four or five others who were aware of the MAGIC intercepts.. Only some were relocated -- those that were in the small Western Zone. They could move to other sites voluntarily, or if they couldn't afford to do so, they could accept housing in relocation camps where they were free to come and go during the day, I understand. If they were of college aid, they could go to college -- on the government's tab I believe. Many did. The politically correct are still griping about it and if you go to the internet, the "relocation camps" are now all termed "internment camps".

The true cause of the relocation couldn't be revealed at the time, for to do so would make the Japanese aware that we had broken their diplomatic and naval codes -- one of these was referred to as "the purple code". The battle of Midway showed it was worthwhile to have kept that secret. It helped our victory at sea that we badly needed and turned the tide of the naval war in the Pacific.
