The 1st iraq war did not result in an overall occupation, it was ended with a seize-fire and an un-control regime on arms to follow. It is that seize-fire-agreement that was violated. Necessarily, a violation of seize-fire-agreements results in military action. The violation is not so much having the arms but rather about not complying with the rules to control them.
