Should have declared war on Islamists

If congress had declared war on all the radical Islamist organizations after the World Trade Center attack then the legality of these situations would have been straight foreword. Since America would be officially in a state of war, the declaration would have facilitated the prosecution of treasonous activities and the acceptence of many issues in the conflict between personal freedom and national security. In a war that will no doubt last for another 50 years, I am stilled baffled by the lack of any serious discussion on this issue.
