This is one of the many rightwing issues that have been thoroughly debunked. They really don't deserve comment any more, but I will nonetheless note that the court in the case to which you refer has already dismissed the plaintiff's complaint. The plaintiff came back with another attempt and a motion to dismiss that complaint is pending, and I expect it will soon be granted.
