Where there's smoke there's fire

Daniel Pipes writes that "prosecutors detained him without charges for more than a month in an Oregon jail while they pored over the evidence." Then he writes that Hawash "donated more than $10,000 to the Global Relief Foundation, an Islamic charity subsequently closed for financing terrorist groups." Where there's smoke there's fire, but I wonder why the prosecutors could not charge Hawash with associaton with the Global Relief Foundation, a sufficient charge for detaining him.
